ALP Studio MLS Terms & Conditions
This Agreement is entered into between ALP Studio (“Company or Artist”) and the hiring client (“Client”).
By engaging Company services, Client agrees to the following terms:
1. Ownership
All media created by Company, including but not limited to photographs, video, drone footage, floor plans, virtual tours, and derivative works (“Media”), remain the exclusive intellectual property of Company.
No copyright transfer occurs. Only a limited license is granted.
No exclusivity is granted unless expressly agreed in writing and subject to additional licensing or exclusivity fees. Company reserves the right to license theMedia to other parties, including project stakeholders, publications, and commercial entities.
2. Grant of License
Company grants Client a limited, non-exclusive, non-transferable, non-sublicensable license to use the Media solely for marketing the specific real estate listing for which the Media was produced.
3. Authorized Users
Authorized users are strictly limited to:
Listing Realtor
Listing Brokerage
Co-Listing Agent
Homeowner (for listing marketing only)
Marketing agencies, real estate agents, and service providers engaged by the Listing Realtor or Listing Brokerage for the purpose of marketing the specific listing
4. Permitted Sharing & Third-Party Use
Client may provide the Media to Authorized Users and to third parties acting on behalf of an Authorized User for the purpose of marketing the specific real estate listing for which the Media was created.
Such use may include, but is not limited to:
MLS and real estate listing platforms
Brokerage websites
Social media posts and advertisements
Email marketing campaigns
Print and digital marketing materials
Marketing agencies, assistants, and service providers engaged to promote the listing
The Media may not be used by any person or entity to promote their own business, services, brand, portfolio, publications, awards submissions, products, developments, or unrelated projects without obtaining a separate license directly from Company.
Examples of parties that generally require a separate license for their own promotional use include, but are not limited to:
Developers
Builders and contractors
Architects and designers
Home stagers
Marketing agencies using the Media for self-promotion
Publications and media outlets
Commercial businesses and project stakeholders
Platform-native social media sharing features, including reposts, story shares, collaboration posts, tagging, and embeds, are permitted.
Any use of the Media beyond marketing the specific listing for which it was created requires a separate license from Company.
5. Term
The license is valid only during the active MLS listing period.
Upon sale, expiration, cancellation, withdrawal, or relisting, all rights automatically terminate after 30 days unless renewed in writing. Previously published marketing materials are not required to be removed after license expiration; however, no new marketing, reposting, redistribution, commercial branding use, or renewed promotional use is permitted without written renewal or additional licensing from Company.
Any reuse of the Media for a new listing of the same property, whether by the same or different agent, requires a new license.
External reuse requires a new licensing agreement, which may include additional costs.
6. Modifications
Permitted modifications include:
Standard MLS resizing and cropping
Color and exposure correction
Virtual staging
Standard branding overlays
Any modification beyond conventional MLS marketing requires written consent.
Prohibited actions include:
AI-generated derivative content
Re-editing by third-party media companies
Alteration beyond MLS marketing context
Commercial reuse outside listing promotion
7. Payment & License Validity
Failure to pay may result in:
Immediate suspension of license
Removal demand
Interest at 2% per month (24% annually)
Recovery of legal fees and collection costs
Unauthorized use constitutes copyright infringement.
8. Indemnification
Client agrees to indemnify, defend, and hold harmless Company against any claims, damages, liabilities, losses, or expenses (including attorney’s fees) arising from:
Unauthorized use
Breach of this Agreement
Third-party intellectual property claims
Privacy or publicity claims
9. Scheduling & Administrative Fees
The following fees apply:
$75 per service — Change/cancellation within 24 hours
$75 per service — Revisit fee due to client-related issues
$125 per service — On-site cancellation
Weather rescheduling (no fee if prior to 24 hours)
10. Travel Fees
Additional travel fees may apply for services in the following areas, calculated on a per service booked basis:
West of West Vancouver Dundarave
East of North Vancouver Windsor Park
Port Moody
Coquitlam
Port Coquitlam
Maple Ridge
Pitt Meadows
Langley
Surrey
White Rock
Delta
11. Rates
All rates are subject to change without prior notice.
12. Service Default
Unless otherwise specified at the time of booking, Premium Photography shall be the default photography service provided.
13. Credit
Where applicable and platform-permitting, credit shall read:
Photo/Video by ALP Studio
Credit is not required for MLS or standard listing platforms unless otherwise agreed.
Editorial publications are expected to provide credit where customary.
14. Breach
Violation of this Agreement may result in:
Immediate termination of license
Retroactive licensing fees
Legal action
Copyright enforcement
Company reserves all rights under applicable copyright law.
15. Governing Law
This Agreement shall be governed by the laws of the Province of British Columbia, Canada.
